CUSTOMER CARE

SALES TERMS AND CONDITIONS

The following terms and conditions (Terms) between you, the customer (you, your)
and Green Era  (we, us, our) apply to the sale of goods and supply of services
by us to you. In purchasing goods from us or engaging us to provide services, you
agree to be bound by these Terms.

Definitions

"Site" means www.greenera.co.nz

"You" means the customer

"Us/We/Our" means Green Era 

"Goods" means products listed for sale on our Site

"Services" mean services provided on the site - namely consignment selling service

"Price" means the amount paid by you for the goods and services

Placing Orders

You may purchase Goods by following the instructions on the Site and paying the Price using one of the methods available at checkout on the Site (Order).

Price

You agree that the Price shall at all times be:

(a) In New Zealand dollars;

(b) Inclusive of GST; and

(c) Inclusive of delivery, as added to the final price at checkout.

Payment

You shall pay the Price in advance at the time of checkout, by using the third party payment provider portal nominated by us at the time of checkout. Your order for the Goods shall not be confirmed until the Price is received by Green Era in cleared funds, without deduction or setoff.

Supply

Condition

We carefully review the condition of the items listed on our Site and list any substantial flaws with the goods. Please be aware that all screens display colours differently and it is possible that the image that is on your screen will not exactly match the colour of the item once it is delivered. It is the nature of preloved goods that there may be minor flaws in the goods that have not been listed.  We do our best to check that the brands listed on items are authentic by reviewing items carefully, however, we cannot guarantee the authenticity of any items list on this page. On this basis our goods as sold in an "As Is" condition. We are happy to meet the requirements of the Consumer Guarantees Act 1993 and will seek to remedy any major flaws that may be present in any goods. 

 

Out of stock

If the Goods that you have ordered are not in stock, we will notify you by email and, if you have already paid the Price, we will refund you the Price. Due to the nature of our items there is only one item of each in stock. It may be that if two people process a sale at the exact same time that the item will sell to someone. Items are not safe from sale to others while in your cart. We will honour the sale to the first customer to complete the sale at checkout, if an item becomes out of stock after the second or later customer has completed a sale you will have your order refunded. 

Delivery

Once you have placed an order and paid the Price, we will arrange delivery of the Goods to your nominated shipping address. We do not offer a click and collect service. If there is damage to your parcel during delivery a photo needs to be take of the package prior to opening and then photos of the damage that has incurred to the items within. We will then work with you to lodge a claim with our courier company for the damage and arrange to compensate you for the damage once a claim has been lodged with the courier company. 

Returns

Once we receive an order, you cannot cancel the Order unless we provide our prior written consent.  We will not complete returns for change of mind returns. At our discretion we can allow for returns if the items is the incorrect size. Please email us to discuss whether we will grant returns at our discretion. 

Where Goods and Services do not meet the requirements of the Consumer Guarantee Act 1993 (CGA) we will meet our requirements to provide a remedy as required under the CGA provided that you can provide proof of purchase of the Good or Service. 

Price 

The price on our website will be honoured at the time that a purchase is completed, we reserve the right to change the pricing on our site at any time.

Gift vouchers

Gift vouchers are valid for 12 months from the date of purchase, or as otherwise agreed in writing by us. Gift vouchers will not be refunded.

Loyalty Programme

Our loyalty programme is offered as an additional bonus for our customers. The terms of the loyalty programme are subject to change at any time. This may mean that the loyalty programme will cease to operate or the amount required to redeem rewards may change. We will provide 30 days notice of any changes to our loyalty programme to allow you to redeem any rewards before changes are implemented.

These terms and conditions (the "Terms and Conditions") govern the use of Green Era (the "Site"). This Site is owned and operated by Brigette Riddle. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

All content published and made available on our Site is the property of Green Era and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

When you create an account on our Site, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

  2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Third Party Goods and Services
Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.

Limitation of Liability
Green Era and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Green Era and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
These Terms and Conditions are governed by the laws of New Zealand.

Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

1. Stripe and Afterpay are our payment processing systems and they will have access to the personal information needed for you to complete the sale.

We may share user data with third parties for the following purposes: 1. To complete the sale.

 Third parties will not be able to access user data beyond what is reasonably necessary to achieve the given purpose.

2. If it is required for any legal proceeding;

3. To prove or protect our legal rights; and

4. To buyers or potential buyers of this company in the event that we seek to sell the company.

How Long We Store Personal Data

User data will be stored until the purpose the data was collected for has been achieved. You will be notified if your data is kept for longer than this period.

However nothing online is free from risk of a cyber attack, we do our best to keep your information safe.  While we take all reasonable precautions to ensure that user data is secure and that users are protected, there always remains the risk of harm. If we learn that we have collected personal data from a child under 16 years of age, the personal data will be deleted as soon as possible.
